Benjamin Wieck is a member of Burke, Warren, MacKay & Serritella's Consumer Financial Services Litigation and Class Action Defense groups.  He concentrates his practice on class action defense of banks, mortgage lenders, and related entities in federal and state courts.  These cases involve numerous federal claims under the Fair Credit Reporting Act, Fair Housing Act, Equal Credit Opportunity Act, Real Estate Settlement Procedures Act, Truth in Lending Act, and the Fair Debt Collection Practices Act, as well as claims for violations of state consumer protection statutes.

Mr. Wieck also has wide-ranging experience representing clients in complex commercial litigation matters in federal and state courts, including contract disputes, employment litigation, construction litigation, government and internal investigations, bankruptcy litigation, consumer fraud, white-collar crime, criminal defense, and regulatory matters. Prior to joining Burke, Warren, MacKay & Serritella, Mr. Wieck practiced in the litigation department at Jenner & Block LLP in Chicago.


Representative cases and decisions in which Mr. Wieck had a prominent role:

  • In re Sykes, 554 F. App'x 527 (7th Cir. 2014) (defending lender in case where Seventh Circuit upheld the District Court’s dismissal of borrower’s appeal from bankruptcy court’s modification of automatic stay)
  • Gibson v. Chase Home Finance, LLC, 2011 WL 6319401 (M.D. Fla. Dec. 16, 2011) and 2012 WL 1094323 (M.D. Fla. Apr. 2, 2012) (dismissing all claims for monetary relief in lender placed flood insurance class action alleging excessive premiums and coverage requirements, and illegal kickbacks to servicer’s affiliated insurance agency)
  • Barger v. EMC Mortgage Corporation, et al., 2011 WL 4712209 (N.D.Cal. Oct. 7, 2011) (denying class certification in case alleging RESPA violations)
  • Charleswell v. Chase Manhattan Bank, N.A. (Case No. 3:01-119, D.V.I.) (defending loan servicer in class action alleging fraud, violation of the Racketeering Influenced Corrupt Organizations Act (RICO), and other claims arising out of lender placed insurance)
  • In re Ameriquest Mortgage Co. Mortgage Lending Practices Litigation (MDL  No. 1715, N.D. Ill.) (defending loan servicer in consolidated multi-district litigation challenging lending practices of originating lender)
