Daniel Klapman's practice is dedicated to serving the needs of clients ranging from entrepreneurs to Fortune 500 companies in complex litigation cases before state and federal courts across the country. He is a partner in the Litigation practice at Burke, Warren, MacKay & Serritella.
Mr. Klapman represents clients in a wide variety of matters, including shareholder and other business investment, ownership, and governance disputes and commercial contract cases. He also handles matters concerning unfair competition, the Uniform Trade Secrets Act, copyright and design patent litigation, distributor and manufacturer-representative disputes, construction and real estate litigation, consumer fraud, lender liability, franchise agreements, defamation, labor and employment matters, and landlord-tenant relations. In addition Mr. Klapman conducts internal corporate investigations. Mr. Klapman also represents clients in all facets of litigation and is experienced in alternative methods of dispute resolution, including arbitration before the AAA mediation and pre-litigation workouts, including the negotiation of separation agreements.
Mr. Klapman began his practice in the public sector, bringing to Burke, Warren six years of investigative and prosecutorial experience from the State's Attorney's Office, where he served in several different divisions training and supervising many junior attorneys.
Mr. Klapman is a member of Burke, Warren’s Litigation, Business Partner and Shareholder Disputes, Internal Investigations, Labor and Employment, and Consumer Financial Services Litigation groups.
Mr. Klapman has resolved cases in various jurisdictions, both early on in the litigation process, minimizing client’s legal expenses, and where settlement is unattainable, by taking cases to judgment before both judges and juries. His recent cases include multiple disputes between shareholders under Illinois’ Business Corporation Act; prosecution of withdrawal liability claims for a local union; unfair competition, copyright infringement, tortious interference, and non-competition claims between two large competitors in the corporate learning and development consulting field; construction litigation defending one of Chicago’s premier commercial and residential builders; and disputes between a successful beer importer and its former and current local distributors. Mr. Klapman also recently resolved a matter between two railroad companies with a large presence in the Midwest.
Honors & Awards
- Despite the long hours spent at the office, he somehow received the Greatest Dad Ever award six years running (admittedly, chosen by his own children). He has also found the "baby" in the King Cake sent by clients in New Orleans every Mardi Gras (currently one for five).
Mr. Klapman is a member of the Chicago Bar Association and Illinois State Bar Association. He has co-presented a seminar on Criminal Law for the Civil Practitioner, providing credit for continuing legal education for other attorneys. Mr. Klapman also regularly provides pro-bono services to members of the community who could not otherwise afford legal representation. He also finds time to coach basketball for the Northbrook Park District.
