Profile

Joseph Hylak-Reinholtz is a partner in Burke, Warren, MacKay & Serritella’s Healthcare and Corporate practice groups. Joe helps healthcare entrepreneurs and providers achieve their business objectives by negotiating and closing transactions while ensuring compliance with ever-changing federal and state healthcare regulations. His clients include hospitals, dialysis facilities, ambulatory surgery centers, nursing homes, assisted living facilities, independent diagnostic testing facilities, and substance abuse treatment providers. Joe’s experience includes more than a decade working within Illinois government focusing on healthcare, regulatory and complex budgetary issues. 

Joe advises healthcare providers on business formation, sales, mergers and acquisitions, financings, and contracting with federal and state agencies and third-party vendors. In the regulatory arena, he counsels clients on establishing and maintaining compliance with federal and state privacy, data security and other healthcare laws and regulations including the Health Insurance Portability and Accountability Act (HIPAA), the Health Information Technology for Economic and Clinical Health (HITECH) Act, the Stark Law, the anti-kickback statute, corporate practice of medicine and fee-splitting prohibitions.

Previously serving as an ex-officio member of the Illinois Health Facilities and Service Review Board for more than three years, Joe represents, advises and assists healthcare providers with certificate of need (CON) applications and related matters. He helps clients assess CON applicability to a proposed project and develop strategies for obtaining state board approval. Joe also represents healthcare facilities and individual practitioners in the pursuit and renewal of licenses, certifications, permits and registrations.

Prior to earning his law degree, Joe served as a senior policy advisor in the Office of the Director of the Illinois Department of Healthcare & Family Services and as a research/appropriations analyst in the Office of Michael Madigan, Speaker of the Illinois House of Representatives. Joe has a clear understanding of state and federal laws affecting nursing homes, residential homes for persons who are developmentally disabled, and assisted living and supported living facilities. He counsels clients on related statutes and regulations, including the Nursing Home Care Act, the Assisted Living and Shared Housing Act, the Life Care Facilities Act, the Public Aid Code, the federal Social Security Act and related provisions.

Joe speaks on healthcare issues at conferences and seminars sponsored by organizations such as the Illinois Health Care Association, the Illinois Association of Healthcare Attorneys and the American Association of Homes and Services for the Aging. He is also the author of articles in publications such as Health Care Law Monthly and HealthLeaders Media.
