CHICAGO, AUGUST 13, 2019 – Burke, Warren, MacKay & Serritella, P.C. is proud to announce that experienced trial lawyer, employment law attorney, and Navy veteran Brian Weinthal has joined the firm as a partner. With a distinguished record of service and success, and an approach that has earned him the respect of clients, colleagues, and adversaries alike, Brian further enhances Burke Warren’s already robust litigation, dispute resolution, and employment law capabilities.

Brian brings an impressive and diverse background to the firm – one that has seen him leverage his considerable advocacy skills in a wide range of matters and forums from Chicago to Washington, D.C. to Guantanamo Bay, Cuba. His commitment to the highest standards of professionalism and personal ethics and his courtroom achievements are reflected in his “AV Preeminent” peer review rating from Martindale-Hubbell, as well as the numerous commendations he received while serving in the United States Navy’s Judge Advocate General’s Corps (JAG).
A graduate of The Johns Hopkins University who earned his law degree from Northwestern University School of Law (as well as a Master of Laws (LL.M.) in Litigation and Dispute Resolution from The George Washington University Law School), Brian served in the JAG Corps for six years. Eventually rising to the rank of Lieutenant Commander, he defended clients at more than thirty contested court-martials involving allegations of inchoate, pecuniary, and violent crimes. He later became a prosecutor with the Office of Military Commissions – the litigating unit assigned to prosecute suspected al Qaeda and Taliban members detained by the Department of Defense at Guantanamo Bay (“GTMO”).
Upon completing his military service, Brian worked as a trial lawyer for a highly specialized commercial litigation boutique in Washington, D.C. He then continued building his litigation practice at an AmLaw 100 law firm before joining Burke Warren.
Brian focuses his practice on the defense of employment-related lawsuits, including allegations of discrimination, retaliation, and hostile work environment. He has unique experience overcoming both whistleblower protection and sexual harassment claims, and considerable proficiency attacking and defending non-compete covenants. He also maintains a highly active trade secret litigation practice for those clients who believe their most valuable corporate information may have been compromised.
Always prepared to defend and advance his clients’ interests in contested litigation, Brian is also ever cognizant of the need to resolve matters as efficiently and cost-effectively as possible. To that end, he often crafts and implements creative strategies that include alternative dispute resolution proceedings when they offer the best opportunity for positive outcomes.
