Defense of state law receiver against Motion for Temporary Restraining Order and Preliminary Injunction and in related litigation

A reputable state law foreclosure receiver was sued by a disgruntled litigant outside of the supervision of the foreclosure court and without notice to the other parties to the foreclosure action. The litigant filed a motion for temporary restraining order and preliminary injunction seeking to compel the receiver to spend receivership funds in a manner not authorized by the court orders appointing the receiver or by the Illinois Mortgage Foreclosure Law. Brian was appointed as special litigation counsel for the receiver and obtained the denial of the TRO and preliminary injunction, the consolidation of the foreclosure action and the lawsuit filed against the receiver, and the dismissal of the suit filed against the receiver.
