Burke Warren Partner Brian Weinthal Named New Chief Administrative Law Judge of the Illinois Human Rights Commission

Burke, Warren, MacKay & Serritella, P.C. is pleased to announce that firm partner Brian Weinthal has been named the new Chief Administrative Law Judge of the Illinois Human Rights Commission (“Commission”) effective January 24, 2022. Mr. Weinthal was recruited for this important position by the Illinois Governor’s office and the Commission. While we whole-heartedly congratulate him on this opportunity, which is an impressive recognition of his considerable talent, we are of course sorry to be losing him as a valued member of the Burke Warren family.

Mr. Weinthal’s new position is established by Article 8 of the Illinois Human Rights Act, and serves as both a hearing officer and a supervisor for the other administrative law judges who hear cases for the Commission. At any given time, the Commission has approximately 500 to 700 active cases, each of which deals with some form of discrimination in the areas of employment, real estate transactions, education, public accommodations, and access to credit. Formal discovery and dispositive motion practice occurs in these cases, and the rules of evidence apply to any proceeding that is eventually held.
