Corporate Transparency Act Filing Requirement Reinstated for Incorporated Community Associations

|
Alert

As of February 18, 2025, the Corporate Transparency Act (CTA) filing requirement has been reinstated and Beneficial Owner Information (BOI) reports are again required for incorporated community associations. According to a public announcement from FinCEN, the reporting deadline is now March 21, 2025. The full FinCEN publication is available here.

Previously, an order from a Texas district court stayed CTA compliance nationwide. This order has been lifted, reinstating the requirement. Absent further intervention by the judicial, legislative, or executive branch, all incorporated community associations must file their initial BOI report by March 21, 2025. For community associations who have already reported, any subsequent change in board members must be reported by March 21, 2025.

Please contact James Stevens (jstevens@burkelaw.com) with any questions on filing requirements for your BOI reports.
