Represented Employee-Owned Company (ESOP) and ESOP Trustee in Insurance Coverage Litigation Related to Clients' Choice of Counsel to Defend ERISA Lawsuit
Represented an Employee-Owned Company (ESOP), its selling shareholders and directors, and its ESOP Trustee in insurance coverage litigation. When our clients were sued for alleged violations of ERISA, the company's insurer demanded that our clients accept unqualified panel counsel to defend the ERISA lawsuit or pay for the full cost of their own lawyers and resolution of the suit. Our clients rejected the insurer's effort to appoint unqualified panel counsel and hired their own, highly qualified and experienced attorneys to defend the ERISA lawsuit. We then represented our clients in a separate lawsuit against the insurance company, demanding that the insurer pay for the defense and indemnification of the ERISA lawsuit, which led to a favorable settlement for our clients.
