Chris Kentra and Blake Roter, the Co-Chairs of the Firm’s Insurance Recovery Practice Group, will be speaking next week at the 2024 Annual Conference of the National Center for Employee Ownership in Tampa, Florida. The event brings together the leaders of employee-owned companies with experts and advisors – attorneys, accountants, consultants, trustees and others – to discuss legal and corporate developments and strategies.

Together with Ted Becker of McDermott Will & Emery, Chris and Blake will present: “What to Do when Your Fiduciary Liability Insurer Denies Coverage.” They will discuss the most common grounds for insurers to deny coverage or reserve their rights, while presenting case studies regarding how insureds have responded to obtain the coverage to which they were entitled.

The case studies covered will provide attendees with useful knowledge for when they obtain insurance policies, learn information about potential insurance claims, and respond to their insurer in the face of a coverage denial or limitation. These case studies will address denials of coverage based upon no claim being received, late notice of a claim, an exclusion that precludes coverage and parties not fitting within the policy’s definition of an insured. The presentation will also discuss coverage limitations related to an insured’s choice of counsel, payment of counsel’s standard rates, high self-insured retentions, insufficient limits and coverage for only defense costs, and eroding/wasting limits. These are all issues which the Firm’s Insurance Recovery Practice Group has addressed, and continues to address, in its work for policyholders.
